Is this an issue with the check itself or a suggestion to change the plugin guidelines? For the latter, https://github.com/WordPress/wporg-plugin-guidelines is probably the best place to start suggesting a change. Then the check can be adjusted accordingly.

Yes.

It shouldn't report an error for any "for trademark" anywhere. e.g. "Do something for WooCommerce" does not report an error, but "Do something for WooCommerce and Xyz" does, which makes no sense.
